Compensation Protection Service

If you have won your personal injury claim, the money you are awarded is intended mainly to compensate you for your pain and suffering and financial losses caused by your accident.

 

If your award is made and you do not have a personal injury trust in place, you could lose your entitlement to present and future means tested benefits. This is because receiving the compensation money will amount to a change in your circumstances making you ineligible for certain benefits.  The result may be that instead of making your life a little more comfortable, your compensation may simply be eaten up in day to day expenses that would otherwise have been met by your benefits.  You will be no better off!

 

Even if you are not in receipt of means tested benefits, a personal injury trust may still be relevant to your circumstances. 

 

If a compensated person is not mentally capable then his or her affairs will need to be dealt with through the Court of Protection.
