Withdrawal Of Treatment Cases

Withdrawal of treatment cases - we have dealt with cases where the Trust may take steps to seek consent from a patient or from a patient's family (where the patient is a child or has no capacity) in order to withdraw treatment from that patient based on argument that it is clinically not in that patient's best interests for such treatment to continue.

It is very important that patients affected by these circumstances seek specialist legal opinion as to these issues as soon as first indications are given by the Trust. In circumstances where there is disagreement between the medics and the family concerned the medics will need to apply to Court for the Court to adjudicate as to the patient's best interests.
